Terms and Conditions
The contract for a short term rental shall be made between the client and the owner. The contract is only effective once the transaction has been approved by us via email or telephone, the required payment has been received and written confirmation sent to the client. **Due to the current COVID-19 pandemic we will aim to be as flexible as possible considering all circumstances and accommodate postponements or refunds if possible**
When submitting an online booking you will be presented with details of the total rental charges together with details of the amounts payable. A deposit of 25% of the rental will be due at the time of booking. The balance of the rental and refundable security deposit is payable 62 days prior to arrival. For bookings made less than 8 weeks in advance, the total amount is payable on the booking. Provisional bookings can only be held for up to 48 hours and will be cancelled if not confirmed within this time.
The client is advised to take out a separate holiday cancellation insurance. Any cancellation should be in writing or by email. On receipt of notice of cancellation we will seek to re-let the property for the whole period. **Due to the current COVID-19 pandemic we will aim to be as flexible as possible considering all circumstances and accommodate postponements or refunds if possible** If the property is re-let for the whole period we shall refund the rental paid less an administrative charge of £50. If we only succeed in re-letting the property for part of the period booked we shall refund an amount equal to the monies paid less (1) 50% of the rental for the period that is not re-let and (2) and an administrative charge of £50. If we are unable to re-let the property before the final payment is due, the client still remains liable for 50% of the final payment on the due date as indicated in the payments section. If we are successful in re-letting the property for the whole or part of the period of the booking after the client has made the final payment, the client will be reimbursed in accordance with the refund conditions above.
Period of hire
Rentals commence at 4pm on the day of arrival and terminate at 10am on the day of departure. We cannot be held responsible for the Villa not being ready for occupation should clients arrive earlier than stated in their confirmation letter. Likewise, departure has to be by 10am and no later. Any deviation from this should be discussed on booking and will only be effective if written confirmation is sent to the client.
Number of guests
The number of guests occupying the property must not exceed 8. Children over the age of 2, not sleeping in a travel cot, count towards the total number of guests.
Clients are reminded that Villa Mimosa is non-smoking. All traces of smoking must be removed from terraces, patios and gardens etc by the hirer by the end of occupancy. Please note that an extra cleaning charge may be levied on refundable deposit if smoking has taken place in the property.
Pets are not permitted in the property under any circumstances. We reserve the right to ask any guest who has failed to adhere to this to leave and the client forfeits all rights to compensation and refund of monies paid. Furthermore, please note that an extra cleaning charge will be levied on refundable deposit.
Care of property
The client is responsible for leaving the accommodation as they found it, tidy and organised and in clean condition with beds which have been used stripped if at all possible, and for ensuring that all members of his/her party behave in a responsible manner in both relation to the property and being considerate to neighbours. Refuse should be bagged up and disposed of in accordance with instructions in the villa welcome pack.
We do ask clients to report accidental breakages immediately and, where deemed necessary, leave payment for replacement/repairs at the end of their stay. Faults or failure with any equipment within the villa unreported by previous visitors should also be reported immediately in order that steps can be taken to remedy. We will aim to ensure that the villa is maintained to a high standard. In the event of a breakdown, a repair/replacement shall be found/fitted within 48 hours where possible. We cannot be held liable for a breakdown of any facility which is beyond our reasonable control or from any misuse or negligence of the client using the equipment.
Your rental includes the provision of air conditioning/heating and hot water. This is based on reasonable and normal usage within the house and does not cover extra appliances brought by guests. If usage is deemed excessive clients will be informed and an appropriate amount levied on refundable deposit. We will supply a starter pack for the fire but guests will be expected to purchase more as required.
WiFi is provided for recreational purposes and is not meant for business use. This service cannot be guaranteed at all times (subject to third party service provider) and the speed may vary. The owner will not be held responsible nor will compensation be given as a consequence of loss of service or slow speed.
Refundable security deposit
A refundable security deposit is applicable to all bookings and is held in case of unreported breakages, loss or damage to items, any excess cleaning or refuse disposal required at the end of occupancy. This will be refunded within 7 working days of departure.
Personal injury and loss of client property
The client or members of his/her party cannot hold the owners responsible for injury sustained or the loss or damage to any belongings during their stay. The proprietor accepts no liability of accident, injury, loss or damage sustained by any residents, their family, visitors, animals, vehicles or personal effects however caused.
The swimming pool is provided for guests only. It is guests responsibility to supervise children at all times in and around the pool area and the owner accepts no liability of accident, injury or death. Clients nor any member of their party are to adjust the filtration, timing or any other settings associated with the pool. Any additional maintenance costs due to guests tampering will be levied on refundable deposit.
The alarm and associated emergency buttons are for clients peace of mind and security. Clients will be provided with instructions on the correct usage of the alarm. Incorrect usage may result in emergency services attending the villa. If deliberate repeated misuse is reported we reserve the right to ask guests to vacate the villa early. Any damage to any part of the alarm and monitoring system will result in an additional charge being levied on refundable deposit. Any additional maintenance costs due to tampering or misuse will be levied on refundable deposit.
Air conditioning units
Air conditioning units should only be running with doors and windows shut and whilst guests are at the property. Failure to comply with this may result in the units freezing up and excessive electricity usage. Additional maintenance costs due to this will result in an additional charge being levied on refundable deposit.
Circumstances beyond our control
If for any reason Villa Mimosa is not available or has been rendered unsuitable for holiday letting (e.g. water damage / fire damage) on the date booked we will endeavour to offer alternate dates, or offer a refund of all monies paid by the client. There shall be no further claim against the owner. Your stay at our property should be an enjoyable break. Nevertheless, should you have any cause for complaint, please advise us immediately, as it is difficult to investigate complaints of any nature once a client has returned home. Regrettably, therefore, it is unlikely that complaints can be accepted and investigated at the the end of the hiring period or after the client has departed.
